1. Introduction
These Terms govern your use of RareCars.com (the "Site") and its services, operated by Rarecars, Inc, a California corporation ("we", "our", "us"), based in Silicon Valley, California. By using the Site you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2. What RareCars.com is
- RareCars.com is a marketplace where private sellers and dealers list collectible, classic, exotic and rare cars, and buyers contact them.
- Unless a page says otherwise, we are not the buyer or seller in a listed sale and are not a party to the sale contract between buyer and seller. For a Fast Cash Offer, the offer comes from RareCars.com or a dealer partner, and the sale contract is between you and whoever buys the car.
- Buyers and sellers are responsible for checking the car, its title, history and condition, and for completing the sale.
3. Eligibility and accounts
- You must be at least 18 years old.
- You are responsible for your account and for keeping your login details safe.
- Our sign-up, listing, inquiry, contact, Fast Cash and newsletter forms use a human check, and some use email verification, to stop abuse.
4. Listings
- Review: we review listings within 24 hours and may decline or remove any listing.
- Accuracy: sellers must describe their car truthfully and have the right to sell it.
- Photos: dealer photos are shown as the dealer provides them. Sellers must own or have the right to use the photos they upload.
- Private Sale: a one-time fee of $49. There is no charge when you submit. After we approve your listing, we email you a link to pay the $49; you are charged when you pay, and your listing goes live once it is paid. A declined listing is never charged. It stays live until it sells.
- Dealer Sale: 30 days free, then $99 per month, with no contract. Card details are entered after sign-up. The plan renews monthly until cancelled. You can cancel from your dashboard, or by emailing sales@rarecars.com. Cancellation takes effect at the end of the current paid month, and there are no partial refunds.
- Fees: prices shown on the Site at the time you sign up apply. We will give notice at least 30 days' notice by email before changing the price of an active Dealer plan.
5. Payments and refunds
- Payments are processed by Stripe. We never receive your full card number or security code; we may store limited card information (brand, last 4 digits, expiry). You must be authorized to use the payment method you provide.
- Refunds: a declined Private Sale listing is never charged. Dealer plan months are not refunded in part when you cancel. Once a Private Sale listing is live, the $49 fee is not refunded, except for a duplicate charge or an error on our side. Contact sales@rarecars.com with any billing question.
6. Buyer inquiries
- When you send an inquiry, we send your name, contact details and message to the seller or dealer of that listing, so they can respond.
- Replies from the seller or dealer go to your email, and you receive the seller's or dealer's contact email so you can reply. After that, you may continue by email.
- RareCars.com receives a copy of each inquiry.
- Do not use inquiries for spam, unrelated offers or harassment.
7. Fast Cash Offer
- Submit your car and we will respond within 24 hours.
- An offer is valid for 7 days unless it says otherwise.
- Payment for an accepted offer is by cash, wire transfer or cashier's check.
- An offer depends on the car matching the information and photos you gave, an inspection, and a clear title in the seller's name.
- To submit a request, you must agree that RareCars.com may share your car and contact info (including car details and photos) with dealer partners. Our team shares them by hand.
- Submitting a car does not oblige you to accept an offer.
8. Newsletter
You can sign up for our newsletter with your email address. We send it only after you verify your address, and you can unsubscribe at any time by emailing sales@rarecars.com.
9. Acceptable use
You agree not to: 1. Break the law or post false, misleading, offensive or infringing content. 2. Scrape, overload or disrupt the Site, or get around its security or human checks. 3. Use the Site to send spam or to contact users for unrelated purposes.
10. Your content
You keep ownership of content you post. You give us a non-exclusive, royalty-free, worldwide license to host, display, reproduce and promote it on the Site and in our marketing of your listing, including our social media and newsletter, for as long as it is on the Site and as needed afterwards for records.
11. Intellectual property
We own the Site, its design, text, logos and software, except content posted by users. You may use the Site for its intended purpose only.
12. Disclaimers
The Site is provided "as is" and "as available". We do not inspect or guarantee any car, listing, seller, dealer or buyer, and we do not warrant that the Site will be uninterrupted or error-free. We review listings, but we do not inspect cars.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any dispute between buyers, sellers and dealers. Our total liability to you is limited to the greater of the fees you paid us in the 12 months before the claim or $100.
14. Indemnification
You agree to indemnify and hold harmless Rarecars, Inc and its officers, directors, employees and agents from claims arising from your use of the Site, your listings or content, or your breach of these Terms.
15. Termination
We may suspend or close your account, or remove listings, if you break these Terms or put other users or the Site at risk. You may close your account at any time by contacting us. If we close your account for breaking these Terms, fees already paid are not refunded.
16. Changes to these Terms
We may update these Terms. We will post the new version with a new "Last updated" date. Continued use after that means you accept the changes. For active Dealer plans we will give at least 30 days' notice of material changes by email.
17. Governing law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Santa Clara County, California.
18. Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and us about the Site.
